BYD Responds to Inclusion in United States Department of Defense "Chinese Military Industrial Enterprises List"
Gasgoo has learned that on June 8, 2026, the U.S. Department of Defense updated its “Chinese Military Companies” list pursuant to Section 1260H of the National Defense Authorization Act. BYD and NIO, two new energy vehicle makers, as well as automotive supply chain companies including CATL, CALB, EVE Energy, Hesai Technology, and RoboSense, were added to the list.

In response to the matter, BYD stated in an announcement on the Hong Kong Stock Exchange that the company is not a Chinese military company or a military-civil fusion enterprise, and that there is no legitimate basis for its inclusion on the list. BYD emphasized that the list is not a sanctions list and does not affect the company’s normal business operations or business dealings other than those with the U.S. Department of Defense. The relevant procurement restrictions will not affect the company’s business, and the list of Chinese military companies does not restrict the company from conducting securities transactions.
In addition to BYD, NIO also issued an announcement on the Hong Kong Stock Exchange that day, stating that there is no legitimate basis for its inclusion on the list, as it is neither a Chinese military company nor a contributor to the military-civil fusion of the defense industrial base. NIO also pointed out that the list is not a sanctions list, and that the related U.S. government procurement restrictions will not affect its business or restrict trading in its securities. NIO said it will actively communicate with the U.S. Department of Defense and, if necessary, take legal action to safeguard the interests of the company and all its shareholders.
Both automakers clarified in their announcements the limited impact of the list and stated that they will continue to monitor developments and take appropriate measures in response.
